who want to be certain that they qualify to have their debts discharged. If you
have been referred to us for means testing by your attorney or bankruptcy
preparer, this is probably the level of testing that they want.
If you are seriously considering filing bankruptcy, then this test should be
the starting point. Once you have taken this test and passed it, you can then
proceed with confidence to take the mandatory credit counseling class or to hire
a full service bankruptcy preparer or attorney. It is recommended that you take
the means test before taking the credit counseling class.
Most bankruptcy attorneys prefer clients who they know in advance will pass
the means test, this way, they do not waste their time with people who will not
pass.
When attorneys takes on new clients, they usually have to spend upwards
of $250 just fulfilling the obligations imposed on them by the new law even
before they can proceed. This is known as due diligence and it includes the
means test.
If you have not taken the means test, the attorney is likely
to quote you a higher fee for the increased risk of their expending $250 in due
diligence fees for debtors who do not qualify.
The MT-100 test is 100% accurate and at the same time, it is very easy to
complete. You do not need a list of your creditors and you do not need your
account balances. We ask for only estimates of your income and expenses and
other information you already have at your disposal. The interview process
takes about 15 to 20 minutes.
When you order this test, you receive a logon name and password with which to
log on to our system. You can take the test a total of 5 times. This allows
you to vary the information that you enter for each run. At the end of each
successful run, you will be issued a printable certificate that you can take to
your attorney or bankruptcy preparer as proof that you have passed the means
test.
The certificate also contains a certificate number which your
participating attorney or bankruptcy preparer can validate against our records as additional
proof that you have passed the test.
